Agreement to our legal terms
We are DegreeFindr ("Company," "we," "us," "our"). We operate the website https://degreefindr.com (the "Site") and any related services that refer or link to these legal terms (collectively, the "Services"). You can contact us through our contact form.
These Terms of Use ("Legal Terms") are a legally binding agreement between you and DegreeFindr concerning your access to and use of the Services. By accessing the Services you confirm that you have read, understood, and agree to be bound by these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, YOU MUST DISCONTINUE USE IMMEDIATELY.
We may change these Legal Terms at any time by updating the "Last updated" date. Your continued use after a change means you accept it. The Services are intended for users who are at least 18 years old.
1. Our Services
DegreeFindr is a free school-matching, advertising, and referral service. We help you find schools and programs that may fit your goals and, at your request, connect you with the schools you choose. We are not a school, we do not award degrees or certificates, and we do not make admissions, financial aid, or employment decisions or guarantee that you will be admitted, receive aid, or find a job. Program availability, costs, outcomes, and eligibility are determined solely by each school. Nothing on the Services is academic, career, or financial advice. For official information on federal student aid, visit studentaid.gov.
2. Compensation and advertising disclosure
The schools shown on the Services are paid advertisers. We are compensated when you ask a school to contact you, and this compensation may affect which schools appear and how they are ordered. See our Advertising Disclosure.
3. Your information and consent to be contacted
By submitting our form you represent that the information you provide is true, complete, and accurate and is your own, and you agree to our Privacy Policy, including that we may share it with the schools and education partners on the Services to find programs you may qualify for. A school contacts you only if you agree to that school's own consent, shown next to its name before you request information; that consent is given to the school named in it, may authorize calls and text messages using automated technology, and is not a condition of enrolling or of any purchase. You can withdraw it at any time by telling the school, replying STOP to its texts, or using our Unsubscribe page for messages from us.
4. Intellectual property
We own or license all intellectual property in the Services, including source code, designs, text, graphics, and the trademarks and logos displayed ("Content" and "Marks"), except school names and marks, which belong to their owners. Subject to these Legal Terms we grant you a non-exclusive, non-transferable, revocable license to access the Services for your personal, non-commercial use. No other use of the Content or Marks is permitted without our prior written permission.
5. User representations and prohibited activities
You represent that you have the legal capacity to agree to these Legal Terms, that you will not access the Services by automated means, and that your use will comply with applicable law. You agree not to: scrape or systematically retrieve data from the Services; circumvent security features; upload malicious code; use the Services to harass or harm others; impersonate anyone or submit anyone else's information; attempt to reverse engineer the Services; use the Services for any commercial purpose we have not approved; or submit false or misleading information.
6. Third-party websites and content
The Services link to third-party websites (including the schools you choose). We do not investigate or monitor them and are not responsible for their content, accuracy, or privacy practices. Any relationship with a school is solely between you and that school.
7. Services management; term and termination
We may monitor the Services for violations, take legal action against violators, and refuse or restrict access to anyone for any reason, without notice or liability. We may change, suspend, or discontinue the Services at any time, and we are not liable for any interruption, downtime, or discontinuance.
8. Governing law and dispute resolution
These Legal Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Before initiating any formal proceeding you agree to first attempt to resolve any dispute informally by contacting us and allowing at least thirty (30) days for a response. Any dispute not resolved informally shall be brought exclusively in the state or federal courts located in Florida, and you consent to their personal jurisdiction. To the fullest extent permitted by law, disputes may be brought only in an individual capacity and not as a plaintiff or class member in any class or representative proceeding.
9. Disclaimer
THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICES' CONTENT, ANY SCHOOL OR PROGRAM, ITS ACCREDITATION, COST, OR OUTCOMES, OR YOUR ELIGIBILITY, AND WE DO NOT ENDORSE OR ASSUME RESPONSIBILITY FOR ANY PROGRAM OFFERED BY A SCHOOL THROUGH THE SERVICES.
10. Limitation of liability
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL AT ALL TIMES BE LIMITED TO ONE HUNDRED U.S. DOLLARS ($100). SOME STATE LAWS DO NOT ALLOW THESE LIMITATIONS; IF THEY APPLY TO YOU, SOME OF THE ABOVE MAY NOT APPLY AND YOU MAY HAVE ADDITIONAL RIGHTS.
11. Indemnification
You agree to defend, indemnify, and hold us and our affiliates, officers, agents, partners, and employees harmless from any loss, damage, liability, claim, or demand, including reasonable attorneys' fees, arising out of your use of the Services, your breach of these Legal Terms, or your violation of any law or the rights of a third party.
12. Electronic communications and signatures
Visiting the Services and completing online forms constitute electronic communications. You consent to receive electronic communications and agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communication be in writing. You agree to the use of electronic signatures and records, including a checked consent box as your signature.
13. California users and residents
If any complaint with us is not satisfactorily resolved, you can contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834 or by telephone at (800) 952-5210 or (916) 445-1254.
14. Miscellaneous
These Legal Terms and the policies posted on the Services constitute the entire agreement between you and us. Our failure to enforce any provision is not a waiver. We may assign our rights and obligations at any time. If any provision is unenforceable it is severable and the remainder stays in effect. No joint venture, partnership, employment, or agency relationship is created by these Legal Terms or your use of the Services.
